      Community Protection Branch

      The High Court delivered a unanimous judgment (NZYQ) finding that unlawful non-citizens cannot continue to be kept in immigration detention for the purpose of their removal from Australia once there is no real prospect of their removal becoming practicable in the reasonably foreseeable future.

      The Community Protection Board (CPB) has been established to provide recommendations to the Minister for Immigration and Multicultural Affairs or their Delegate regarding appropriate conditions which may be necessary to manage a person in the community who may be subject to a Bridging Visa (Removal Pending) BVR.

      The purpose of the Board is to provide informed, impartial and evidence-based recommendations to the Minster or Delegate concerning the necessity (or otherwise) of visa conditions which may be required to be imposed on a person subject to the BVR. The Board will make recommendations with respect to risk to the community and conditions attached to the BVR which may be necessary to be imposed to manage community safety.

      CPB is organised into five sections, with a short summary for each listed below.

      Community Protection Submissions (CPS) Section

      The CPS Section is responsible for the preparation and delivery of operationally sensitive material for the CPB regarding clients in scope. This involves accessing, interrogating and analysing complex datasets from both internal and external holdings in order to produce high quality submission materials. The CPS Section utilises the information gathered and prepares written submissions for the CPB to make informed recommendations.

      The CPS Section engages, coordinates and liaises with internal and external stakeholders to establish and maintain the ongoing acquisition and provision of data required for the preparation and delivery of CPB submission materials. This includes but is not limited to managing required data agreements, data scheduling, Requests for Information, and data repositories. This also includes regular reporting for the Community Protection Monthly report, annual and performance reporting.

      Community Protection Board Secretariat and Governance (CPBS&G) Section

      The CPBS&G Section supports the Board through preparation of communications for members, including providing meeting support (i.e. assisting the Chair to develop agendas, collate and circulate papers, prepare and circulate minutes). Manage meetings, including all logistics (travel, accommodation, catering, venue booking), managing member’s contracts, and all financial records.

      The Secretariat supports its members through recording key recommendations and/or action items from both scheduled and out-of-session meetings. This includes documenting detailed reasons for each recommendation.

      The section also supports the branch governance framework and risk assurance processes and branch BCPs. Governance functions include preparing briefing and other materials for Senate Estimates, Question Time, ministerial correspondence, ministerial submissions and Freedom of Information requests.

      Community Protection BVR Visa Coordination (CPBVC) Section

      The Community Protection Visa Coordination Section (CPBVC) prepares BVR delegate submissions and briefings on individuals who meet the NZYQ (or related judicial decisions) criteria and prepares notification letters for clients. This includes liaising with internal and external stakeholders to obtain contemporaneous information on an individual to assist the delegate in making their visa decision.

      In addition, the CPBVC Section is responsible for managing BVR data and statistics to inform internal and external reporting, including the monthly Community Protection Report published on the Home Affairs website and briefings for Senate Estimates and other external reporting.

      BVR Representation and Review (BVR R&R) Section

      The BVR Representation and Review Section is responsible for co-ordination of the s76E representations made by individuals as to why the visa holder should not be subject to one or more of the conditions prescribed when the BVR is granted.

      The role of the BVR R&R Section is to coordinate and manage all s76E representations; this includes the preparation of submissions and briefings to the BVR Delegate. Pending a delegate decision, this may involve a merits review process. The BVR R&R Section will have responsibility for coordinating and managing this review process with the Administrative Review Tribunal (ART) in line with current policy settings.

      Community Safety Order Scheme Program Management (CSOSPM) Section

      Under the Community Safety Order (CSO) Scheme, the Immigration Minister may apply to a state or territory Supreme Court for a Community Safety Detention Order (CSDO) or a Community Safety Supervision Order (CSSO) in respect of an eligible non-citizen serious offender.

      The Community Safety Order Scheme Program Management (CSOSPM) Section is responsible for designing, developing and subsequently managing program-level arrangements in relation to the implementation of the CSO Scheme. These arrangements include but are not limited to; the CSO implementation framework, capability development, providing program assurance, undertaking governance and risk related activities, managing the Federation Funding Agreements with relevant states and territories as well as, coordinating required CSO program management activities.

      In this capacity, the CSOSPM Section works with internal Department stakeholders and other Commonwealth departments and agencies in the states and territories to maintain the functional effectiveness of the CSO scheme.

      Duties and responsibilities

      • Prepare and deliver high quality operationally sensitive Board submission materials

      • Liaise with stakeholders to ensure the timely collection of relevant data and information

      • Manage team mailbox and disseminate communication as required

      • Maintain data repositories and holdings

      • Provide support to Branch reporting

      • Maintain relationships with internal and external stakeholders

      • Represent the section at meetings and various other fora to achieve ABF and Government objectives collaboratively

      • Assess and report on sensitive information within legislative, policy and legal frameworks

      • Monitor and update information management procedures to ensure the timely, effective and accurate recording, use and storage of information. Exercise good judgement and decision making and escalate as/when required

      • Provide support that builds the capability and capacity of the Section

      • Apply skills to support effective governance, record keeping and reporting.

      To be eligible for the position you must be an Australian Citizen.

      The successful candidate will be required to obtain and maintain a Baseline Vetting (AGSVA) security clearance, and:

      • ABF Workers will also be required to obtain and maintain an Employment Suitability Clearance (ESC).
      • Home Affairs Workers will also be required to obtain and maintain an Onboarding Check.

      In certain circumstances, an Employment Suitability Clearance (ESC) may be required in addition to, or in lieu of, an Onboarding Check, which will be determined by the delegate as necessary.
