Job Description

- Advanced Diploma /National 1st Degree in Labour Law or Labour Relations or equivalent NQF qualification.
- Bachelor of Laws (LLB) is an added advantage.
- Minimum 7-10 years practical experience in labour law and chairing disciplinary and incapacity enquiries, preferably in the financial services sector.
- Accreditation from a dispute resolution agency, CCMA or Bargaining Council is an added advantage.

Job Purpose
To lead and manage the Nedbank unit of chairpersons and ensure effective governance and adjudication of disciplinary and incapacity enquiries in an impartial manner to ensure substantively and procedurally fair and consistent outcomes.
Job Responsibilities
Establish and maintain an independent and impartial unit of chairpersons to preside over disciplinary and incapacity enquiries.
Build a pipeline of chairpersons to ensure availability of additional candidates for succession planning and continuance of the chairpersons.
Lead and manage chairpersons to ensure sound and efficient implementation of disciplinary, and incapacity processes in accordance with Nedbank’s Disciplinary and Incapacity Policy and Procedure, in an independent and impartial manner.
Ensure that all enquiries are conducted on ERDirect, the case management system for disciplinary and incapacity enquiries.
Participate in Group Employee Relations led activities related to the enhancement and upgrading of ERDirect.
Ensure the formulation and implementation of governance processes related to:
o Maintaining the independence of chairpersons
o The avoidance of conflicts of interest
o The conduct of enquiries
o Reporting and administration requirements
Ensure chairpersons are adequately trained and capacitated to undertake their responsibilities with the required technical expertise.
Keep abreast of legislative and case law developments in the field of employment law relevant to the conduct of disciplinary and incapacity processes.
Engage with Group Employee Relations regarding, but not limited to:
the interpretation and application of labour laws.
the interpretation and application of Nedbank’s Disciplinary and Incapacity Policy and Procedure.
Undertake regular post-enquiry reviews to identify and apply learnings and enhancements.
Identify risks to chairperson unit and recommend and implement initiatives to mitigate identified risks, in collaboration with Group Employee Relations.
In collaboration with Group Employee Relations, analyse CCMA disputes which have successfully challenged the outcome of enquiries and ensure learnings and enhancements are applied.
Meet financial objectives by supporting the organisational budgeting process.
Plan the utilisation of resources by balancing available resources against required outputs.
Monitor team to ensure the mental wellbeing of all members.
Manage team effectively and efficiently across the HR value chain including recruitment, performance management, retention of critical staff, succession planning and coaching and talent management.
