Job Description
- Req#: 130913
- Community safety detention orders (CSDO), the effect of which is to commit a person subject to such an order to detention in a prison for the period the order is in force; and
- Community safety supervision orders (CSSO), the effect of which is to impose on a person residing in the community who is subject to such an order certain conditions, the contravention of which is an offence.

On 8 December 2023, the Migration and Other Legislation Amendment (Bridging Visa, Serious Offenders and Other Measures) Act 2023 (Cth) came into effect . Relevantly, this Act inserts Division 395 into the Criminal Code. Division 395 establishes a regime for enabling the Minister for Immigration to apply to a Supreme Court of a State or Territory for a Community Safety Order (CSO) in respect of non-citizens that have been previously convicted for a "serious violent or sexual offence" or a "serious foreign violent or sexual offence" and where their circumstances meet other statutory conditions.
There are two types of CSOs available under the scheme, namely:
A newly established Taskforce to administer the new Commonwealth Community Safety Order Scheme has been stood up. This is a rare opportunity to do quasi criminal and admin law work focused on protecting the Australian Community.

Duties and responsibilities
As a Legal Officer, the occupant of this position is qualified, professional and open to continuous learning and improvement. They hold a degree in laws or are admitted to practice and eligible to hold a practising certificate. They provide legal advice and assistance of a basic to immediate nature. The advice they provide carries risk, and they ensure that it is legally correct, appropriately contextual, practical and effectively informs the Department's management of legal risk. Consistent with legal best practice, their work is second-counselled by a Senior Legal Officer or a peer.
They report to their Senior Legal Officer and may be given opportunities to manage Paralegals or Law Clerks. The work is challenging, complex and varied. The teams often work within short time frames, ensuring Departmental outcomes are maintained. While the Legal Officer is allocated work by their Senior Legal Officer or Director, they have a degree of latitude, and are expected to exercise professional judgment, in the prioritisation and delivery of their tasks, whether the task is a simple question or a project of longer duration.
The Legal Officer provides advice that deal explicitly and candidly with legal risk, advising on what options are legally sound and what other options are legally available.
The Legal Officer consults as necessary with other stakeholders, whether in or outside Legal Group in preparing their advice, which requires a good level of strategic awareness about issues that require consultation and areas to be consulted.

To be eligible for the position you must be an Australian Citizen.
