Job Description

- Reviews all pleadings, applications, motions, orders and decrees pertaining to probate of wills, administrations, heirships, guardianships, anatomical cases, and other similar filings
- Ensures compliance with requirements imposed by case law, constitutional law or statute, and notifies personal representatives of deficiencies in any documents reviewed
- Researches legal issues for the court and drafts briefs and memoranda on various points of law as required by the Court
- Reviews all claims filed in estates and guardianships for compliance with law prior to approval or rejection by the Court
- Compiles and maintains a research file as a prepared reference source for assisting the Court in management of complex litigation cases
- Oversees management of cases transferred to the Probate Court from foreign jurisdictions
- Monitors the status of guardianships before the Court including reviewing compliance with Judicial Branch Certification Commission (JBCC) requirements, annual reports on the condition and wellbeing of the ward, communicating with parties regarding deficiencies with filings, communicating with parties when a need arises to transfer the guardianship case, and setting matters for Show Cause hearings
- Reviews all suggestions of need for guardian or need for investigation of circumstances (“1102s”) filed with the Court and coordinates appoint of guardian ad litem for investigation
- Reviews all small estate affidavits filed for compliance with law prior to approval or rejection by the Court
- Responds to public inquiries regarding probate, guardianship, and other matters before the Probate Court
- Writes and edits articles/PowerPoints on various aspects of probate law
- Provides support to other Court administrative staff
- Maintains court webpage
- Performs related duties as required
- Graduation from an accredited college or university with a Doctorate of Jurisprudence and four (4) years practice in the relevant discipline
- Good knowledge of probate court system; knowledge of Texas Estates Code and Property Code; knowledge of basic legal terminology; knowledge of basic office procedures
- Skill in coordinating multiple cases; skill to develop research methods and perform legal research; skill to operate personal computer and basic office equipment
- Ability to communicate with diverse groups of individuals utilizing tact and diplomacy; ability to follow verbal and written instructions; ability to effectively respond to inquiries and complaints; ability to analyze and appraise facts, procedures and legal precedents affecting complex and simple cases; ability to maintain effective working relationships with attorneys, the general public, co-workers, other County employees and Elected/Appointed Officials
- Must be licensed by the State of Texas to practice law
- Must have valid Texas driver’s license, motor vehicle liability insurance and personal injury insurance; or have a self-reliant source of transportation to conduct business on a daily basis
- Must secure and maintain a favorable background investigation
- Must clear a pre-employment physical and a pre-employment drug screen test
- May work more than 40 hours during the workweek
- Must be fluent in English and Spanish in speaking, reading and writing
- Working conditions are primarily in an office environment
- Frequently moves items weighing up to 10-25 pounds
- Visual acuity, speech, and hearing; hand and eye coordination and manual dexterity necessary to operate computer keyboard
- Subject to bending, twisting, standing and handling to perform the essential functions
- Occasionally moves about the office
- Frequently communicates with others; must be able to exchange accurate information
- Generally operates a computer and other office productivity machinery
- Positions self to perform essential functions
- Must be able to remain in a stationary position
