As a Senior IP Counsel in our India office, you will join a talented and collaborative group of in-house lawyers and legal professionals to support IP legal matters in India. This role will report to an Assistant General Counsel in the European region and will support the India business team either remotely or locally. · Provide legal advice and support to the organization on all IP (legal) matters, including patent, designs, trademarks, copyright, trade secrets, and domain names. · Partner with the commercial legal team to support and facilitate negotiation, review and drafting of IP contracts and related clauses. You will also act as a resource and point of escalation where product or IP matters are the focus of a given commercial negotiation, including licensing, assignment, and confidentiality agreements. · Collaborate with cross-functional teams, including finance, R&D, marketing, and business development, to identify and mitigate IP risks in the organization's products and services. · Monitor and advise on IP-related disputes and enforcement matters, including infringement claims and domain name disputes and coordinate with global IP Legal Services team. · Collaborate with the Patent Portfolio Development team and Strategy and Operations team on IP strategy, process and implementation within India and Schneider Electric Businesses. · Ensure compliance with relevant IP laws, regulations, and internal policies across the organization, including developing and implementing IP policies and training programs for employees. · Stay up-to-date on legal and regulatory developments in the IP field and advise the organization accordingly. · Support regional M&A and corporate transactions from an IP perspective (such as IP audit). · Assist Trademark Counsels to manage trademark portfolios, including trademark clearance, filing, prosecution, oppositions, and cancellations and communication with India marketing and Business stakeholders. · Liaise with external counsels and service providers on IP matters and provide instructions as necessary. · Manage IP (Legal Services) budget within the territory. o · Coordinate with global IP team to maintain and update IP-related databases and records. Qualifications · LLB or JD from a recognized university. · Qualified lawyer with at least 8 years of experience in IP law, preferably in-house or at a reputable law firm. · Fluent in English (and Hindi or Kannada are preferred), both written and spoken. · Strong knowledge of local and global IP laws and regulations, including patents, designs, trademarks, copyright, and trade secrets. · Proven track record of drafting and negotiating IP agreements and providing legal advice and support on all sorts of IP matters. · Excellent drafting, negotiation, and communication skills.
