      Job Description Summary

      Job Title: Senior Lawyer – Embedded Finance
      Locations: Edinburgh, Halifax, Leeds, Bristol, Chester or Cardiff
      Hours: Full Time
      Working Pattern: Our work style is hybrid, which involves spending at least two days per week, or 40% of our time, at one of our office sites.

      This is an excellent opportunity to join a vibrant, dedicated, value adding legal team who work hand in hand with the business to build excellent customer outcomes! The Cards, Loans and Transport businesses sit in the Consumer Lending division. The fundamental nature of those businesses are to offer lending and financing for consumers and vehicle leasing to businesses in the UK.

      We're the number one provider of credit cards distributed through the four iconic brands of Lloyds Bank, Halifax, Bank of Scotland and MBNA. The same brands offer personal loans to individuals and is one of the top unsecured personal loan providers through the Transport division (Black Horse and Lex Autolease) we offer vehicle finance and leasing facilities for both personal and business customers. Black Horse is the leading independent provider of non-captive motor finance. Providing point-of-sale finance to over 900,000 end customers supporting them to purchase their vehicle of choice through 4,700 dealerships.

      Also included in the Consumer Lending family is “Embedded Finance” division set up to enable customers in non-financial journeys to access financial products at point of need. Whilst this may focus on lending solutions, such as Buy-Now-Pay-Later, embedded finance encompasses broader financial services such as payments and insurance. Embedded Finance will be the home of the soon to be launched Merino embedded finance proposition providing customers with a revolving line of credit with the flexibility of instalment plan repayments within the revolving line.

      Job Description

      You’ll be dedicated to Embedded Finance and you’ll be required to work alongside the leadership team of Embedded Finance as they approach the full launch of Merino and be able to provide both legal and strategic support for the Embedded Finance business while Merino is established as a core product and while the business develops further propositions.

      • You will provide insightful, commercial advice, and legal expertise to senior business and support partners, and facilitate the delivery of excellent outcomes for customers and for LBG across all the products the team supports.
      • As well as being able to provide and/or source general legal support for Embedded Finance we'd like you to have technical knowledge of consumer credit law, general consumer law as well as applying FCA Principles, FCA rules (e.g. CONC) and Payment Services Regulations.
      • In addition, going forward implementing the higher standard of customer treatment under Consumer Duty will be a key requirement.
      • Using your technical expertise to provide specialized training or mentoring to others.
      • You’ll also be required to deputise for Head of Legal for CLT Legal when required.
      • We'll be looking for you to focus on growing your own capabilities and investing in personal development by identifying and using the many opportunities within the team.

      Key Accountabilities:

      As a Senior Lawyer supporting Embedded Finance you’ll be encouraged to provide advice on all aspects of customer journeys, from the on-boarding of customers through to servicing, collections and recoveries processes, contractual documentation, letters, rectifications and new regulations in a way that makes a real difference to a customer’s experience. This includes the ability to support and provide legal advice on the following:

      • Customers in financial difficulty/insolvency.
      • Customer complaints.
      • Rectifications & remediations.
      • Persistent debt.
      • Consumer duty.
      • Digital journeys.
      • Customer terms & conditions reviews.
      • New product offerings.
      • Legal developments (statutory or otherwise).
      • Risks are addressed and appropriately raised, reported, escalated and shared.
      • Training needs of the businesses we support.
      • Deliver legal technical input to influence projects, with a significant impact across the Group or a number of Business divisions.

      A key aspect of the role is organising and working collectively with the many lawyers (both within CLT Legal and outside) across the Legal Community to provide joined up legal support needed for the successful launch. This will include lawyers in litigation, contentious regulatory, competition, data protection and commercial contracts issues.

      In addition, you will:

      • Assist in any dealings with the FCA, PRA and other regulatory or trade bodies. This may involve helping to craft external thinking on the reform of consumer credit and consumer protection legislation;
      • Work in partnership with other Group, Divisional and Business Divisions - in particular Digital Engagement, Finance, Risk, CCOR and Operations;
      • Help to deliver the engagement model between Legal and our customers; and
      • Initiate, lead and participate in Legal and Secretariat initiatives.

      Key Capabilities

      • At least, a qualified solicitor with a minimum of 5 years post qualification experience (or have equivalent legal qualification or experience).
      • Responsibility for the provision of high quality legal and commercial advice and support to relevant partners on a wide range of their needs.
      • Sound legal, commercial and risk judgement and understand and build an effective Legal risk management framework.
      • Build effective working partnerships and consensus, applying positive relationship management and interpersonal skills.
      • Required to work effectively with senior management and executives across a variety of functions, not only to ensure compliance with legal requirements but also to proactively challenge, advise and influence senior management on legal issues.
      • Change management - You'll be an action-orientated leader who is able to challenge existing thinking, bringing the team along with you, working in an agile way to transform products and services.
      • Thrive on challenge and be able to balance multiple competing demands through uncertainty or ambiguity.
