      About the Role:
      The Senior Specialist, Lease Solutions will manage caseload of leases to be settled. Communicate with SMO/BDs, landlords, legal to negotiate lease settlements and manage settlement process including the disidentification and surrender of sites to landlords. Work on other projects such as the disidentification backlog and taking on relocation settlements.

      Responsibilities include but are not limited to:

      • Review various databases to determine restaurant status including, but not limited to, Closure Smartsheet Tracker, Subs, Tango and Onbase. Review lease and any related amendments and addendums for relevant clauses such as rent, lease term, renewal, limit of liability, kickout, surrender conditions, notice provisions, security deposit, etc. Discuss back rent owed with Back Rent Specialist, if needed. Check with Finance to see if funds were escrowed.
      • Work with SMO/BDs to determine next steps for the restaurant including equipment removal, disidentification, surrender, settlement and escrow of funds by franchisee. If restaurant was abandoned work with Diane S/ Lisa V to send appropriate abandonment notices for the franchise agreement, sublease and equipment (if necessary).
      • If the Company needs to remove equipment and/or disidentify a location work with the field to obtain quotes from a contractor (may require multiple quotes). If the quote is reasonable give authority (up to $5000) or seek authority from Supervisor. Once work is completed and pictures received confirming work is done to our satisfaction and site properly disidentified work with BD/SMO and Analyst to get contractor paid (need invoice, ACH letter and W-9). If the franchisee performs the equipment removal and disidentification review pictures to confirm proper disidentification and surrender conditions.
      • Seek settlement authority from Supervisor if franchisee did not escrow funds. Negotiate lease settlement with the landlord/landlord attorney for the best possible outcome for the Company and BD/SMO. May need assistance from RE Legal with settlement negotiations.
      • Once settlement is agreed, request lease termination agreement from RE Legal. Once drafted review for accuracy. Send to landlord/landlord attorney for review. This may require several rounds of edits. LSM to manage process between RE Legal and landlord/landlord attorney. Once the document is finalized work with Analyst to arrange execution. If payment is to be made to landlord request ACH letter and W-9. The analyst will arrange payment once the agreement is fully executed.
      • Request Analyst to send settlement checklist along with lease termination agreement to various teams such as RSM, Diane Schackner and Monetary Compliance. Update Asana notes and tasks so matters can be transparent and tracked accordingly.
      • Disidentification project - review site surveys and disidentification pictures to determine if site is properly disidentified and if not, what needs to be done. Engage contractor for quote, seek authority if needed, work with landlord and field team to gain access to premise, if needed. Once work is completed, review pictures, arrange payment to the contractor.

      Qualifications:

      • Bachelor’s Degree preferred in Business with a focus on real estate and/or legal.
      • 3-5 year relevant experience.
      • Must be detail oriented and have the ability to multi-task. Must have great oral and written communication skills. A legal or real estate background would be helpful.
      • Understand lease language/ ability to interpret lease language.
      • Ability to work in a project management system.
      • Negotiation skills.
      • Multi-tasking.

      Actual pay is determined based on a number of job-related factors including skills, education, training, credentials, qualifications, scope and complexity of role responsibilities, geographic location, performance, and working conditions.
