- Patent development including selection of inventions to protect, oversight of outside counsel’s patent drafting and prosecution, and ensuring favorable return on the investment to build Peloton’s patent portfolio
- Trademark portfolio development and enforcement to ensure global growth of Peloton’s brand and elimination of brand abuses, including infringements and counterfeits
- Develop freedom to operate strategies, including design around options, inbound licensing, and efficient resolution of infringement allegations
- Experience leading investigations and negotiations to resolve patent, copyright and trademark disputes
- Provide advice on strategy and matter management related to offensive and defensive IP litigation matters
- Supervise U.S. and foreign outside counsel in connection with strategy and management of all aspects of IP enforcement and dispute proceedings
- Draft cease and desist letters and other correspondence relating to infringement of intellectual property, and handle resolution of routine matters as the primary point of contact with adversarial parties
- Work closely and cross-functionally with Brand and Product focused legal teams, providing an IP and litigation perspective on matters being addressed to achieve their goals
- Support the objectives of internal business clients and advise on legal risks and opportunities
- 12+ years of relevant experience, law firm and in-house high-tech IP legal experience preferred, with a demonstrated competency with digital and software-enabled technologies
- Experience in all aspects of IP, including patent litigation, licensing, and portfolio development preferred
- Bachelor's degree in chemistry, electrical engineering, computer science or related field preferred
- Juris Doctorate degree and member in good standing of at least one U.S. state bar
- Registered to practice before the US Patent & Trademark Office preferred
- Experience with Android Open Source software highly preferred
- Highly knowledgeable on technical, scientific and legal aspects of intellectual property
- Strong experience with patent clearance/freedom-to-operate issues
- Strong experience with standards essential patent licensing and litigation
- Experience negotiating technology agreements, including licenses and IP provisions
- Leadership of internal teams and external outside counsel teams
- Strong command of U.S. and global IP conventions, systems, and procedures, and the ability to distill complex concepts into “plain English” for internal clients and counterparts
- Ability to work independently with Peloton team members throughout the U.S. and globally, meeting demanding deadlines in the face of ambiguity and triage effectively, adjusting tasks frequently
- Outstanding critical thinking skills, with a bias for action and confidence to make informed decisions that have both legal and business implications
- Excellent communication and interpersonal skills, with an interest in working cross-functionally

ABOUT THE ROLE
Peloton is looking for a strategic, collaborative and dynamic leader with 12+ years of experience, including time at a top law firm and in-house high-tech practice, to join our Legal team. As leader of our Intellectual Property team, you will report directly to our Chief Legal Officer and will be responsible for clearing IP risk to Peloton’s business and protecting Peloton’s technology and brands. This will include driving strategy and execution of patent, trademark and copyright portfolio development, transactions and secondary patent market engagement, enforcement, and dispute resolution. You should be able to understand new technologies quickly, and work with both engineers and business leaders to establish IP related actions that advance Peloton’s technology and product roadmap. This position requires a thorough understanding of Peloton’s multifaceted business, including its partners, Members, and competitors, in order to support the achievement of business objectives.

Base Salary: $318,500.00 to $414,000.00
The base salary range represents the low and high end of the anticipated salary range for this position based at our New York City headquarters. The actual base salary offered for this position will depend on numerous factors including individual performance, business objectives, and if the location for the job changes. Our base salary is just one component of Peloton’s competitive total rewards strategy that also includes annual equity awards and an Employee Stock Purchase Plan as well as other region-specific health and welfare benefits.
